I agree you can lose a game from bad luck. You can win a game from good luck. Neither apply in this case. I am not whining about bad luck. We cheated. We did not play the game as it was designed. And because of that, any result - win or lose - is invalid.

You didn't cheat.

Ya, we did.

Cheating is often misunderstood because it has gotten so married to intention. Cheating ignores intention.

That's true. I'm not arguing intent, I'm arguing you didn't break any rules. I might be missing something here (have read the rules but not played yet) but the actions you took were all fine by the rules, there was just one action you didn't use. In any given game, there are likely to be actions you don't use.

It is a weird situation I'll give you that. It's like if you were accidently use six cards to build a research station instead of five. That would be cheating. But only because you can't otherwise voluntarily discard cards. In a case like that I could see your reasoning. It's not screwing up the rule that would be cheating, it would discarding an extra card when you are not allowed to.

Thanks to snoozle, I am seeing that now. Sometimes something that should be obvious just needs a different presentation. :)
